‘Militia’ Redefined

A message from our friends.

“Official Militia Gear was created when a group of brothers, sitting around a table after training one late Friday night, were discussing the negative connotations associated with the word “Militia”. We decided that we that needed to find a way to change the stigmas associated with Militias. Our common purpose, core beliefs, brotherhood and unity spawned something we already knew.

The Militia, as defined in the Militia Act of 1903, was to “consist of all able-bodied men age 17-45″ that were not already part of the organized armed forces. With current laws regarding equality, that could technically be expanded to encompass everyone, regardless of age, ethnicity, or sex. That means WE ARE ALL THE MILITIA!

Our goal as a brand is to build awareness and get more Americans training! We all own guns, but we should also be proficient with them. Without a skilled professional behind them, our tools are worthless.

Our goal as a company is to carry the best products available! We want you to be able to take our gear, and eventually our guns, into the field with you and put them to use. We will only deliver products we can stand behind. Guns and gear that will hold up to the rigors of heavy, day-to-day use. If its hot, we train. If its cold, we train. If its wet, we train. You shouldn’t have to worry about your gear failing you when you need it the most!

We hope you enjoy this site as we grow. As always, we appreciate you stopping by and look forward to meeting you someday.

For Freedom,

Official Militia Gear Team”

Coalition to Stop Gun Violence and Senator Chris Murphy Targeting US Citizens as “Dangerous Insurrectionists”

Senator Chris Murphy thinks you are a dangerous terrorist.

Senator Chris Murphy thinks you are a dangerous terrorist.

The “Coalition to Stop Gun Violence” (CSGV) is a radical leftist front organization funded by donations from globalists and sponsored by some of the most crackpot organizations, such as “Code Pink.”  Their clearly stated intent is to aggressively force gun control upon the United States are willing to use “social justice,” which is code for social terrorist campaigns designed to ruin anyone that resists their agenda.  Recently, they have started a campaign designed to force WTTG General Manager Patrick Paolini to fire a pro-Second Amendment reporter Emily Miller http://csgv.org/action/tell-wttg-general-manager-patrick-paolini-fire-emily-miller/.  Emily’s high crime was exercising her First Amendment right to support the Virginia Citizens Defense League (VCDL).  The VCDL has been an effective and vocal advocate of gun rights for Virginians and thus, Emily has been targeted by CSGV and has become a victim of social terrorism.  I want to take the time today to expose these treasonous enemies of a free and sovereign nation and shine the light on their leadership, which to date has enjoyed immunity from their harassment and terrorist tactics.  I also want everyone to stand up for Emily and make sure her Manager Patrick Paolini stands by her.

I coined the term “social terrorism” because anyone that has been victimized by one of these well-funded smear campaigns labeled “social justice” can literally have their lives ruined.  Social justice is social terrorism so correct anyone when you hear it improperly used.  If you think the term is too severe then consider the implications.  Victims of social terrorism generally are condemned for supporting Christian virtue, the rule of law, and republican values.  These victims have been targeted by the IRS and Justice Department with frivolous investigations, arrests, audits, delays, and fines; have had their businesses destroyed and lost their jobs; have been blacklisted at public events, been unable to get business loans or new jobs; had their children abducted by social services; had their reputations smeared; and have been harassed, physically assaulted, and targeted for killing.  If this doesn’t constitute systematic terrorism of an individual, nothing does.  Now Emily Miller, a lady that has worked hard in her career is under attack for advocating for our Bill of Rights and everyone needs to know she must be defended.

To fight the CSGV, you first need to know a little about them and how they view “us.”  According to their website, part of their stated strategy is “to use the term ‘insurrectionism’ to describe the NRA’s treasonous interpretation of the Second Amendment.” Apparently, they have found some success because Senator Chris Murphy is on record supporting their organization and making the statement, “The Coalition to Stop Gun Violence has led the way in exposing the dangerous insurrectionist ideology promoted by the NRA and others in the pro-gun movement” http://csgv.org/about-us/.  Think about the term “insurrectionist” for a moment.  Insurrectionist is defined as an act or instance of rising in revolt, rebellion, or resistance against civil authority or an established government.  Read more

Florida Outlaws Off-Grid Living Update

You know what they say about imitation.  If rewriting the work of others is included, I should be happy because The Daily Sheeple (http://www.thedailysheeple.com/) featured a great article today, contributed by a Joshua Krause, on “Florida Court Rules Off-Grid Living Illegal,” which was picked up and run also by http://www.infowars.com/.  However, I wrote nearly the same, albeit more detailed, article almost a year and a half ago (http://www.lastminutesurvival.com/2015/01/04/florida-outlaws-off-the-grid-living/).  I appreciate the word getting out, which is the goal.  However, common courtesy is that you at least put in a footnote about your sources.  In fairness, when news breaks, we see a lot of articles essentially citing the same information to get the news out, but a year and a half later when you are writing, it is called research not news.  Don’t get me wrong, I love checking out the articles on both The Daily Sheeple and InfoWars so please frequent these sites.  However, if their contributors are going to rewrite stories I broke a year and a half ago, please, either just repost/link to the entire original article or ask me to contribute directly.  We are all on the same team and there is plenty of news to still report.

5 Things Preppers Forget to Stock

Recently, there has been so much going on politically it has been easy to overlook writing on core survival/prepper subjects.  To make sure our prepper followers don’t think I have forgotten about them, I wanted to note five preps that I see overlooked quite often.  These preps aren’t vital like water and food or something like antibiotics that have been discussed repeatedly.  These are preps that are important, but easy to forget when preparing for a long term post-SHTF world.  By no means is this list all inclusive, but it does touch on some key items we take for granted.  The following items should be a part of your stocked supplies and are listed in no particular order. The Baltimore Riots again prove the government cannot and will not protect you. Why local organization is your best security.

Baltimore thugs proving they are thugs. Source: Breitbart

Baltimore thugs proving they are thugs. Source: Breitbart

Once again, the evidence is overwhelming that government orchestrated civil disorder led to the destruction of large parts of Baltimore.  Again, like in Ferguson, the “dog whistles” of the American Left have signaled it was justified to burn, to destroy, to loot, to assault, and to vandalize.  These rioters, not the protestors, were by and large scum and certainly presented the image of a career criminal class living on welfare unleashed on society.  If any of the rioters find that assessment offensive, then perhaps you shouldn’t act and look like a heathen.

Post riots, the violence in Baltimore has skyrocketed while the police claim they have been undermined and cannot do their job.  I certainly will side with the police over what I witnessed rioting, but for them to intentionally disengage in protest is a dereliction of duty.  I am sorry some (possibly good cops), got wrapped up in what appears to be a politically motivated knee jerk reaction, but then, when someone gets their neck broke and you are the only one around, the average person would expect to be arrested.  If the Baltimore Police have become so accustomed to killing people with no consequences that this comes as a shock, then perhaps it was a necessary overreaction by the prosecuting attorney.  Either way, I won’t accept thug rule any more than an utterly corrupt police department with the nerve to refuse service.  Allowing gang rule to “punish” the citizens, while still collecting pay checks is despicable and has no honor in it.  I do empathize with the police and believe in law and order, but they cannot act as though they had no role to play in the chaos that has plagued Baltimore.  Read more

US Liberty movement should take a page from the Clinton playbook and seek foreign support from Russia and other foreign nations

Fort Ross, California

Fort Ross, California

Seeking foreign support for liberty minded political movements may sound counterintuitive, but it will prove critical in the coming years.  Having studied successful political movements and revolutions globally, the historical precedent for requiring foreign support is sound.  In fact, if one has studied the history of the American Revolution, one will quickly realize just how integrally linked the liberty movement is with foreign support.  We like to think we alone whipped the British, but it was the French intervention that sealed the final defeat of General Cornwallis’ British Army at Yorktown, Virginia.  Today, support from our Old World allies is unlikely, but welcome; however, support from those that challenge or are being attacked by globalist interventionism is far more likely.  Read more

Jade Helm Explained: What it is, what it isn’t, and what you can do to resist.

Your training starts now.

Your training starts now.

Many of my readers have been asking about the upcoming Jade Helm exercise.  Naturally, citizens should have a healthy suspicion of any military exercises and especially ones that appear to target a domestic threat.  However, is the hysteria really warranted or is it all being overly hyped?  I have remained mute on this issue because I was hoping the military would through official channels come clean and explain the true nature of the exercise, which is better described as an operation.  Of course this has not happened and there are deliberate reasons why the military has remained opaque.  As such, I want to explain the operation in a way that to date hasn’t been reported.  The truth about the exercise is it is really an operation and there are reasons for real concern, but also, there is a large degree of hype that has clouded the public’s understanding.  Nonetheless, Jade Helm is just a symptom of far bigger conspiracies unfolding across the US government.  To be prepared, you will need to understand the dynamic currently afoot, which is far bigger than any one exercise.  Read more

Irony of the Day: Why Leftist opinions don’t matter and how to fight back

Few people are more vocal and utterly driven by blind ideology than the adherents to leftist ideologies  By leftist I generally umbrella anyone ascribing to communist, socialist, fascist, or other “progressive” ideologies even though in a purest political science realm we could debate over the semantics.  At no point is logic or even historical precedence, respective of the validity of their political arguments, allowed to enter into their conscious understanding of the world.  Their world is a nonsensical false utopia based on long ago debunked political alchemy and universal truths cannot be entertained.  Their world is one of emotional opinion based on the manipulation of the facts and reality as it stands.  These leftist ideologies have led to the deaths of hundreds of millions of people globally and are unmatched in their totalitarian brutality, yet both academia and the masses spout this vile rhetoric.  These facts are inescapable to the unbiased student of political science.  The left’s ideological war must be countered because it is poison to a free society.  As such, I want to take a moment to point out one of the most glaring, ironic, hypocrisies of the left.    Read more

Who benefits when the world attacks Yemen? Al Qaeda and the Elite.

Who benefits when the world attacks Yemen?  This is a question that policies makers should have asked before allowing the president to start another foreign war.  In fact, it was asked and the answer was Al Qaeda.  Being that Al Qaeda would be the ultimate winner, one must wonder what kind of treason allowed this war to proceed.  In spite of this knowledge, the United States still backed an Arab coalition in a completely unjustified offensive war against Yemen.  The purported purpose was to bring back the ousted president, but anyone with half a brain would immediately know this was preposterous.  Yemenis are not going to ever accept a president that used a foreign militaries to kill its citizens to regain power.  Thus, knowing that the US was aware that by weakening the Houthi rebels they would by default strengthen Al Qaeda and still not achieve their stated goal, one must look deeper to reveal very disturbing consistencies in US Foreign Policy.

To recap, since the ouster of Yemen’s president widely seen as a US puppet, Saudi Arabia has overtly and the US clandestinely bombed Yemen.  The Houthis still retain power and the population is even more aligned against the ousted president than before the war against Yemen was unleashed.  Further, AQ broke into a prison and released 300 terrorist prisoners.  Al Qaeda has also made significant territorial gains and seized military bases containing weapons stockpiles.  In the meantime, a humanitarian disaster has ensued with thousands of civilians being killed in the bombing raids and fighting while many Yemenis are starving to death.  This operation by any bar has been a total failure and is becoming a humanitarian disaster.  However, no one in the media or Congress is calling out President Obama, the Nobel Peace Prize recipient, for starting an unconstitutional war, losing it, and killing thousands of innocent people all while aiding our enemy.  Why? Battlefield America: The War On The American People

In order to be prepared for and to effectively resist the coming crises, you must understand your enemy and what is happening around you.  Further, you must find common cause and unite against tyranny.  The Rutherford Institute has been successfully fighting  many of these constitutional battles in the courts on all of our behalf for some time.  This hasn’t been free and John Whitehead has dedicated a considerable amount of his own time and money to this cause.  I ask you today to support John and his organization as a true modern day American hero and buy his book.  I am confident the information will be valuable and the money you spent will be supporting our cause.  Please note that neither John nor the Rutherford Institute in any way asked me to endorse their organization and there is no need.  John has proven through action that is a man living by a higher calling and demonstrated at great personal risk he is a champion of freedom and liberty and for that he has my support.

“A government which will turn its tanks upon its people, for any reason, is a government with a taste of blood and a thirst for power and must either be smartly rebuked, or blindly obeyed in deadly fear.”—John Salter

We have entered into a particularly dismal chapter in the American narrative, one that shifts us from a swashbuckling tale of adventure into a bone-chilling horror story.

As I document in my new book Battlefield America: The War on the American People, “we the people” have now come full circle, from being held captive by the British police state to being held captive by the American police state. In between, we have charted a course from revolutionaries fighting for our independence and a free people establishing a new nation to pioneers and explorers, braving the wilderness and expanding into new territories.

Where we went wrong, however, was in allowing ourselves to become enthralled with and then held hostage by a military empire in bondage to a corporate state (the very definition of fascism). No longer would America hold the moral high ground as a champion of freedom and human rights. Instead, in the pursuit of profit, our overlords succumbed to greed, took pleasure in inflicting pain, exported torture, and imported the machinery of war, transforming the American landscape into a battlefield, complete with military personnel, tactics and weaponry.

To our dismay, we now find ourselves scrambling for a foothold as our once rock-solid constitutional foundation crumbles beneath us. And no longer can we rely on the president, Congress, the courts, or the police to protect us from wrongdoing.

Indeed, they have come to embody all that is wrong with America. Read more

When the SHTF, You Can Come to My Place…Seriously

How often have you been talking with friends and they joke that if the SHTF, they are coming to your place?  Most of us quietly are saying in our heads, “you are out of your damn mind if you think you are coming to my place.”  In fact, for those that spend zero time preparing, training, or putting even the smallest amount of effort into their own survival insurance, I would agree, I have no sympathy.  However, the mere fact you are reading this right now tells me you have taken a step in the right direction and are in fact interested in insuring the continued existence of yourself and your family.  You are actively trying to take positive steps.  For those of you out there, I would suggest established preppers consider opening their door and taking you in under the right conditions.  Unlike the billionaires creating much of the havoc in our world, very few of us will ever have the funds to buy our own private island or renovated missile silo protected by a first rate mercenary army so it is best we start working together.  In today’s article, I will deviate from what I consider dated prepper logic and argue why inviting others to your bug out location is in all of our interests.    Read more

LMS Civilian Response Team: Ferguson Conundrum Solved by Community Security

When police get it right.

When police get it right.

I wanted to take a moment to follow up on Last Minute Survival’s Civilian Response Team initiative.  Our initiative proved that not just in Ferguson, but that in communities around the country a well-organized community response is far better protection and security than anything the state can provide.  Not only did our teams respond to crisis areas completely ignored by government agencies, but provided real protection to businesses and residents unable to provide for their own defense.  Further, our teams were able to accomplish this without heavy handed police state tactics.  Read more

Update: Why are Virginia police going handing out anti-gun fliers to local businesses?

Today, your efforts combined with a grassroots effort across Northern Virginia achieved a small victory.  I want to give a special thanks to the The Virginia Citizens Defense League (VCDL) [http://www.vcdl.org/] and the observant citizens, which identified the subversive activities and went after Alexandria County government officials regarding the use of police for the door-to-door anti-gun flier campaign.  The VCDL was issued a formal apology from the police chief and Alexandria police took down all flyers and signs posted at their police headquarters saying concealed firearms weren’t permitted and admitted they were wrong.  Read more

Success in Ferguson: The Untold Story

Pictures of the criminal Michael Brown Robbing a Convenience Store

Pictures of the criminal Michael Brown violently assaulting a clerk and robbing a convenience store

As news broke last night that Officer Darren Wilson would not be indicted by a grand jury, events unfolded as I warned.  Legitimate, peaceful protests were hijacked by a host of unsavory groups to included anarchists and domestic terrorist organizations like the New Black Panther Party.  The New Black Panther Party is racist terrorist organization whose members were planning to carry out a Boston Marathon style bombing of the Ferguson protests (see: http://www.reuters.com/article/2014/11/22/us-usa-missouri-shooting-explosives-idUSKCN0J602N20141122), which could have maimed and killed dozens of people.  As predicted, the protests provided cover for this mob of anarchists, domestic terrorists, and criminals to congregate and then begin to riot.  Further, because of political pressure, the police were impotent to stop the violence and the National Guard was held back, which left innocent citizens helpless as their cars were torched and businesses looted.  As the sun rose today over Ferguson, the damage was clear.  Entire blocks were burned to the ground, cars were destroyed, stores were looted, citizens were assaulted, and in general, all hell had broken loose.  So where is the success in Fergusson you ask?  The untold story of Ferguson is that many businesses, homes, and property were left untouched not by the design of the mob or by the “protection” of the state, but by brave actions armed, private citizens.  Read more

Citizens in Ferguson Unite to Defend Their Business

Citizens in Ferguson Unite to Defend Their Business

What really happened and who is right in the on-going social unrest in Ferguson, Missouri that began after an unarmed black man was shot by a police officer?  That is the question we all are asking, but in truth can’t know unless we were there.  Without the ability to have witnessed the events firsthand, one must let the justice system work.  However, it is clear that no matter whether or not the grand jury returns an indictment against the officer involved in the shooting, many will feel an injustice has been committed.  In fact, many have left little doubt that if an indictment, irrespective of the evidence, is not returned, there will be violence http://www.nytimes.com/2014/11/08/us/ferguson-missouri.html.  Our job as citizens should be to protect the innocent, our families, and our neighborhoods from this violence whether it is at the hands of the mob or the police.  With your support, LMS is prepared to help those in need.  To help, please read on and contact us at admin@lastminutesurvival.com, subject line “Help Ferguson.”

Ferguson has already endured more than its share of mob violence.  If protestors want to vent their anger, they should properly focus their aggression against the police, judges, and politicians, but not local residents and businesses.  Further, when protestors target innocent bystanders for simply being “white,” they completely undermine their stated grounds for grievance (see links at bottom).  If race was truly at the root of the Brown shooting, attacking whites, or any innocent person, demonstrates a complete hypocrisy of logic and turns legitimate protestors into a mob.  Acting like a mob gives the police a legitimate justification to harshly crack down on any protests and only spurs more violence.  A well-organized protest should be smart about this and not give the police any justification for the use of harsh crowd control tactics and be cognizant of optics created by the protestors.  Wanton violence does not win the support of the public and only bolsters the state’s argument for heavy handed actions none of us want.  However, in light of the very public calls for violence if the grand jury doesn’t indict the officer as demanded by the mob, we can safely predict in that event protests will quickly descend into mob violence and rioting.

The police are preparing for this contingency and no doubt will respond in force.  Nonetheless, as we have previously reported, http://www.lastminutesurvival.com/2014/08/29/lessons-from-ferguson-policing-goes-paramilitary/, the best way to protect yourself, your family, your residence, and your business was not to rely on the police.  The police have found that they can do little to protect the businesses and residents from rioting mobs and at best try to arrest the most egregious of actors.  This has left business and residents of all races in Ferguson paralyzed by the continuing violence.  In Ferguson, the only places spared by the mob were people who took up arms and organized to defend their lives and property and the wealthy able to pay for contract security.  Clearly we all can’t afford private security, so we are organizing to provide volunteer security services for citizens in need.  In anticipation of the grand jury announcement and possible violence, LMS is establishing a special response team made up of citizens unwilling to allow innocent people to become victims and our cities to burn.  We will be dedicating a page where anyone in need of help can request help or volunteer their protective services.  We are in need of able bodied citizens and organizations of good character to contact us immediately.  Those trained and legally able to carry a firearm in Missouri to include current and former law enforcement and military personnel as well as medical first responders are in great demand.

If you or a loved one has family and friends or a business in or around Ferguson and need protection, email us at admin@lastminutesurvival.com, subject line “Help Ferguson” and we will attempt to match you with volunteers willing to travel to that location and stand guard.  Please post this information to social media such as chat rooms, Facebook pages, Twitter accounts, etc. to get the word out and help the citizens of Ferguson.  For professional support, LMS also provides contract private security consultation and protective services that can be requested at admin@lastminutesurvival.com, subject line “Security and Protective Services.”

“I’ll Come To Your Place When SHTF” – No You Won’t By Glen Tate | 299 Days

(This post is something you can send to your friends or print out and hand to them when SHTF.)

Dear Friend:

I love my friends, but I will shoot you if I have to.  I’m serious.  Here’s why.

I tried to persuade you to prepare for what’s coming and, in the process, revealed that to you that I’m preparing.  You realized that I have food, guns, etc., and ended up saying, half kidding but half serious, “I’ll come to your place when SHTF.”

No you won’t.  I will shoot you.  If you threaten me and my family, I will use force to defend against any threat.  And showing up at my place hungry and unprepared is a threat to me.  You will eat my food and use up my medical supplies, generator, firewood, etc.  That’s less of these life-saving things for me and my family.  That’s a threat. Obama Administration is carrying out Bio-Terrorism inside the USA

Leprosy

Leprosy

A conversation with Americans that watch the news regularly would reveal they are aware and worried about terrorism and Ebola coming to the US.  Their fears are not unfounded, but profoundly biased by sensationalized coverage that has been heavily edited by those with political motives.  To illustrate this point, the threat of terrorists using a biological weapon in the US strikes fear into the heart of Americans, but outside of a small use of anthrax, this threat has never materialized.  However, what if I told you literally tens of thousands of Americans have died and millions have been sickened by a deliberate biological attack.  Wouldn’t that on-going attack generate far more fear, outrage, and a sense of urgency to act?  You would think, but it hasn’t.  In fact, as I write this post, millions of Americans have been sickened and or killed by a host of diseases that were once thought eradicated in the US.  Further, new illnesses are spreading to the US that were either non-existent in the US or extremely rare.  How could this be one should ask.  The answer is simple.  A deliberate government policy that ignores the safety and security of the American people, while undermining the nation’s sovereignty has been put in place and allowed to exist by both Republicans and Democrats vying for greater political power. The Disenfranchisement of America and the Plan to Reverse It

The Constitution says that the number of representatives shall not exceed one representative for every 30,000 constituents.  This ratio was roughly equal to the actual ratio of representatives to the population at the time the Constitution was ratified.  However, today, most states have less than one representative per 700,000 people.  The result of this massive dilution of federal representation in Congress has been a near total disenfranchisement of the population and consolidation of power within two establishment political parties.  In order to begin restoring the balance of power to the people, breaking the party gridlock within Congress, and restoring liberty we must build popular support to overturn the arbitrary limit of 435 representatives set in 1929.  The sooner we build awareness and draw media attention to this issue, the greater the pressure will be on Congress to increase its size and begin to return the power to their constituents.

To begin, for a republic such as the United States to have a functioning representative government, there must be adequate and real representation of the citizen body.  The representatives must be answerable to their constituents and not political parties.  The notion today that a single representative can adequately represent the interests of over 700,000 people is lunacy normalized through decades of slowly eroding the individual’s political value to the point of nonexistence.  Further, the faux representation perpetrated upon the American people today has only been possible because politicians realize that their power is proportional to the number of people they represent.  The exact opposite is true for citizens.  The fewer citizens that are represented by a single representative, the more direct representation and influence the citizen possesses.

The Founding Fathers of the United States had much to say on the topic of what fair representation at the federal level would look like.  James Madison understood the danger of too few dictating to the many and adequately summarized his thoughts as the smaller the House, relative to the total population, the greater is the risk of unethical collusion or myopic groupthink.  In contrast, “Numerous bodies … are less subject to venality and corruption.”  [James Madison, 14-August-1789]   Federalist Paper Number 56 (February 19, 1788) describes this ratio stating, “…it seems to give the fullest assurance, that a representative for every THIRTY THOUSAND INHABITANTS will render the [House of Representatives] both a safe and competent guardian of the interests which will be confided to it.”  Note that the number “THIRTY THOUSAND” was capitalized in the papers for emphasis.

Melancton Smith’s observations deserve special attention as he, perhaps more than any of the other delegates to the Federal Convention, understood the gravity of the situation.  He knew that the power to determine the number of representatives could not be left to the ruling elite, which all too often become addicted to power.  This would be “a power inconsistent with every principle of a free government, to leave it to the discretion of the rulers to determine the number of representatives of the people.  There was no kind of security except in the integrity of the men who were entrusted; and if you have no other security, it is idle to contend about constitutions.” [Melancton Smith]  Smith elaborates on his valid and time proven point that we cannot expect the House to unilaterally increase the number of representatives.  “To me it appears clear, that the relative weight of influence of the different states will be the same, with the number of representatives at sixty-five as at six hundred, and that of the individual members greater; for each member’s share of power will decrease as the number of the House of Representatives increases.  If, therefore, this maxim be true, that men are unwilling to relinquish powers which they once possess, we are not to expect the House of Representatives will be inclined to enlarge the numbers.  The same motive will operate to influence the President and Senate to oppose the increase of the number of representatives; for, in proportion as the House of Representatives is augmented, they will feel their own power diminished.  It is, therefore, of the highest importance that a suitable number of representatives should be established by the Constitution.” [Melancton Smith]

Alexander Hamilton, an opponent of writing limits on representation into the Constitution, provides interesting insights into his logic.  For starters, it appears he neither conceived nor intended the federal government to have the sweeping powers that it possesses today.  “The subject on which this argument of a small representation has been most plausibly used, is taxation.  As to internal taxation, in which the difficulty principally rests, it is not probable that any general regulation will originate in the national legislature.” [Alexander Hamilton]  How Hamilton would have reacted to the reality of the Federal Income Tax, Obama Care, and the litany of other internal taxes levied since the ratification of the Constitution is anyone’s guess, but based on his above statement, one could surmise he would have altered his position on the need to include specific representational limits in the Constitution.  This conclusion is further supported by Hamilton’s statements respective of his belief that the federal government’s powers were limited and would never extend into one’s private life.   “The powers of the new government are general, and calculated to embrace the aggregate interests of the Union, and the general interest of each state, so far as it stands in relation to the whole. … Were the laws of the Union to new-model the internal police of any state; were they to alter, or abrogate at a blow, the whole of its civil and criminal institutions; were they to penetrate the recesses of domestic life, and control, in all respects, the private conduct of individuals,—there might be more force in the objection; and the same Constitution, which was happily calculated for one state, might sacrifice the welfare of another.” [Alexander Hamilton]  Of course we know now that the federal government has grown so oppressive and omnipresent as to invade every aspect of one’s private life.  As such, Hamilton’s grounds for objection, however implausible he may have believed them to be at the time, turned out to be the very grounds that time has proven most required the Constitution to dictate an equitable ratio of representatives to constituents.

Based on the rather clear intent of the individuals ratifying the Constitution, one may wonder how did the number of Representatives become fixed at 435?  The answer is rather simple; because Congress passed a bill in 1929.  The bill sought to prescribe a national policy under which the membership of the House shall never exceed 435 unless Congress, by affirmative action, overturns the formula and abandons the policy enunciated by this bill.  Respective of the number 435, there is no real reason other than that was the number of representatives at the time and the House found it advantageous to their political power to limit the growth further.  Of course the population of the United States has massively grown since 1929, which in effect increased the representation ratio to such an astronomically large number that the mere notion of representation was utterly destroyed.  However, this has only bolstered the power of the representatives and political parties, which have gerrymandered districts to the point of making the election of independent, grassroots connected representatives nearly impossible.  Except for those who are independently wealthy, election and reelection campaigns in super-sized districts require that the representatives raise huge sums of money on a nearly continuous basis.  This makes representatives beholden to the parties and big donors that funded their campaign instead of the constituents they purportedly are there to represent.  In short, this allows special interests, lobbyists, and other corrupting elements to highjack the representative.

To put the state of disenfranchisement in perspective, it is worth noting that Russia as compared to the United States has over 50% better representation of its people.  In fact, the United States has the second worst ratio of population to House representative in the world.  Surely as the “leader of the free world” the United States could muster better representation.

Challenging this notion one may surmise that a larger House would result in even more gridlock in Congress.  However, with an approval rating consistently below 10% and the inability to so much as even pass a budget, it would be hard to imagine a more dysfunctional Congress.  Further, if the above maxim that a smaller legislative body would be much more productive held true, then the Senate would certainly be very efficient.  However, the Senate is as dysfunctional as the House when it comes to operation.  In fact, there are rarely more than a handful of Congressmen from any chamber present during session and even fewer actually engaged in meaningful debate.  In part, this is because the work of the Congress is broke down into committees, which would be no different if the House increased its numbers.  As for anyone that doubts a large body could pass legislation, California is often used as proof this is untrue.  In fact, California has for decades effectively voted on hundreds of propositions.  If the millions of people in California can effectively vote on legislative initiatives, it should be simple for even ten thousand representatives to vote on similar legislation.  Naysayers may also point out that the government is too big already and adding more Congressmen will just make it worse.  This is also untrue and in fact just the opposite would most likely be the outcome.  As the number of representatives increase, Congress will have to become more representative of the people.   The House will be more, not less motivated to reduce the size of the government.  This is because the representative will be far more accountable to their constituents, which will be much better able to monitor their actions.  It is also worth noting that an increase in actual representatives may be closer to an overall neutral growth in government employees because fewer staff members are required to support smaller districts, which would balance against larger staffs to support larger districts.

Each state is guaranteed at least one representative, no matter what its population.  States with a single member in the U.S. House of Representatives are Alaska, Delaware, Montana, North Dakota, South Dakota, Vermont and Wyoming.  The District of Columbia has a non-voting delegate in Congress who has all the powers and rights of a representative, but is not permitted to vote.  Currently, the approximate number of constituents to a representative is around 705,000.  If the ratio was closer to 1:50,000 we would have a House with about 6,100 representatives.  This increase could be dealt with by regionalization of Congress much like the Federal Court Districts, which could have interactive debate via the web and electronic voting.  It would also mean your vote once again counted and you would have real influence at what approximated to what most experience at the state level of politics.  It would once again be difficult for any one party to control Congress.  It would be even more difficult for special interests, big businesses, and lobbyists to buy off Congress simply due to the sheer number or representatives, which would require immensely large sums of money and unavailable financial and manpower resources to gain a majority of support for pork legislation.  The result would be a more accountable, more effective, and more representative Congress.

The notion that we could once again have realistic representation in Congress is not a pipe dream.  It is an obtainable goal that is well within the feasible realm of effective change initiatives liberty minded citizens can unite around.  We must build the awareness of the population that the status quo is unacceptable and that the 1929 law that disenfranchised us today must be overturned.  We need to all write our Congressmen, get on talk shows and radio, use social media, and empower the grassroots movements around this nation to take this goal on as a part of the platform.

The Debates in the Federal Convention

August 6, 1787

As the proportions of numbers in different States will alter from time to time; as some of the States may hereafter be divided; as others may be enlarged by addition of territory; as two or more States may be united; as new States will be erected within the limits of the United States, the Legislature shall, in each of these cases, regulate the number of representatives by the number of inhabitants, according to the provisions herein after made, at the rate of one for every forty thousand.

Overcoming the Greatest Prepper Weakness: The Individual versus the Community and a Plan for the Future

One of the greatest assets to preppers is that they are self-reliant and able to independently operate.  However, it is also their greatest vulnerability.  No matter how tough, how well-trained, how well armed, or how well prepared an individual is, there is only so much one person can do.  Numbers matter.  As an individual, you must eventually sleep and can’t stand guard indefinitely.  You can only be at one place at one time.  A second set of hands on nearly any labor intensive task is better than one.  If sick or injured it is very difficult or impossible to provide prolonged self-aid or surgery.  If directly confronted by an organized and numerically superior force, the odds are decidedly against the individual.  You can only accurately fire one weapon, at one target, at one time.  Further, your best odds of survival if attacked by superior numbers would be to try and escape, but even then it is pretty easy for a larger number of pursuers to head you off and corner even the craftiest of evaders.  As such, for any realistic, long term survival plan, one must build a prepared community.  A community is the foundational bedrock of a society and a nation.  The community is where the individual can truly make a difference and build a better life.  Today’s article is my appeal to you to take action to improve your life, to create new and better communities, and to take back our nation.  I will provide each of you with the template to not just resist, but triumph.  Each one of us has the ability to change the status quo in the present day and no longer be at the mercy of the state, which at one time, represented us as citizens.  Make no mistake, survival is a long term struggle against both nature and tyranny that comes with sacrifice, but we can overcome the odds best through collective action.

Man is neither designed nor equipped to be a solitary animal.  Individually we are weak and vulnerable and would have long ago become easy prey and gone extinct if it wasn’t for banning together.  Since the earliest prehistoric times, man has grouped together in bands and tribes to survive.  Modern man is no exception as we live today more interconnected than ever.  This interdependency has allowed us to specialize, to survive, and to even have leisure.  Man was designed with neither the long claws and fangs of apex predators nor the acute hearing and swift speed of prey.  We don’t come with fur to protect us from temperature extremes and have long since lost our immunities to many parasites commonly found in food and water.  Man’s greatest asset, his mind, combined with strength in numbers has demonstrated that he can overcome nearly any extreme and challenge.  This maxim is as crucial for survival today as it was ten thousand years ago when small bands of Ice Age hunters and gathers grouped together to fend off ferocious predators and take down massive game.

Communities and villages sprang to existence out of the mutual need for security and distribution of labor.  Someone always needed to tend to the fire and be on the watch for predators so that others could safely sleep.  While some hunted the others cooked and farmed.  In modern times, these families became bands, then tribes, and then nations.  As nations grew, man’s greatest threat ceased to be lions and tigers, but his fellow man.  Nation state violence led to the need to collectively organize in even greater numbers or risk being numerically overwhelmed by a neighboring nation.  Internally, the rise of nations led to the rise of brutal tyrants and the further need organize the masses in resistance in order to escape slavery and death at the hands of the king’s mercenaries.

Today, the modern prepper faces all of these challenges.  At the most local level, the prepper must find a way to accomplish the daily tasks of a subsistence existence.  The chores of simply acquiring and preparing food and water, staying warm or cool, maintaining shelter, and creating or fixing the means to accomplish the former are enough to rapidly overwhelm anyone.  However, the prepper must also provide for his common security against potentially large bands of hostile people and what appears to be an increasingly hostile government.  Individually, or at least as a family, it is certainly possible to scratch out a subsistence level of existence as long as you are never confronted by a hostile group.  However, it is simply not realistic to believe that one could independently sustain for the long term when faced with hungry bands of violent, armed, thugs or a hostile, state sponsored tyranny.

As previously stated, I don’t care how prepared you “think” you are; if you are trying to subsist with just a handful of people, an organized group of basically trained thugs with a proclivity for violence will quickly overwhelm you and certainly seize whatever preps you have stored.  This is not a situation of maybe, but an absolute.  The preppers that fail to learn and internalize this are living in a fantasy world.  Preppers that ardently stick to their small groups in remote and isolated areas only delay the inevitable.  This paradigm may be best illustrated by how law enforcement represents a small percentage of the population, but effectively controls the masses by being able to quickly mass and achieve local (tactical) numerical superiority against any resistance.  Individually, there have been literally millions of people arrested that were tough, prepared, and well-armed, but I can’t think of any in recent memory that have successfully fought off a determined attempt at seizure by the police.  Sadly, government has never proven capable of leaving individuals alone and hungry mobs have never shown the proclivity to take the moral high road and starve when the option to loot for food existed.  Eventually, preppers that failed to organize BEFORE a collapse or crisis and build communities will each be independently identified, targeted, and wiped out by thugs or hostile government forces.

The solution to this is not a new one.  It is as old as mankind.  Like minded individuals will once again need to band together to collectively survive.  This is and will be an essential, critical, FACT that preppers must accept.  Preppers need not build communes or cede their independence, but do need to build communities.  These communities need to be aware, prepared, and organized in a manner that they are effectively self-sustaining and self-governing.  It is equally essential to also build the population numbers in a concentrated manner that will change the voting demographic so that elected representatives will not only properly represent, but be of the same mindset of their constituents.  We have seen some of these successes in Montana and Idaho, but are failing to coalesce in an organized manner nationwide.  Only by achieving, at minimum, at first, tactical numerical superiority in targeted regions will free, independent, liberty minded individuals be able to live a life of freedom with liberty in something more than their imagination.

Communities built around self-sustainment are by their very nature resilient to natural disasters, grid failures, and crime.  By locally producing food, water, and power a community can almost completely eliminate the major vulnerabilities of today’s societies.  The society is healthier, happier, and more connected.  By once again localizing industry, the community can build, fabricate, or repair nearly anything and have a vibrant localized economy.  Further, by having a large pool of like-minded citizens, the community can fend off both political and physical attacks.  One threat can be defeated through the ballot box and the other through tactical numerical “superiority.”  To illustrate this point, 100 groups of eight preppers could disperse across the 50 states (two groups to a state).  These small groups have zero political influence or protection and could be rounded up and wiped out in a single night by either hostile thugs or government forces operating in groups so small local law enforcement could field them.  However, if you combined these groups in one area, you would have the local tactical strength of upwards of 800 people.  This is a sufficient number to not just swing, but control elections in smaller districts, install a like-minded sheriff and deputies, and present a unified defense requiring at least a battalion of military regulars to engage with any chance of success.  Imagine getting back to a time and place where instead of fearing police, the local police actually acted to “defend” the locals and keep the peace with the full weight of the people and the law behind it.  Imagine a place where you could walk down the street and not be filmed, photographed, tracked, and fined for violating one of a seemingly infinite number of overbearing regulations.  Now consider the literally millions of like-minded “preppers” that exist in the cities, towns, and the rural expanses of America.  If the media is to be believed, tens of millions of these people are already organized under the nebulous title “Tea Party.”  By concentrating these numbers we not only make being prepared and living free mainstream, but the lifestyle sells itself.  Don’t waste your strength and try to fight the numbers in states like California, Maryland, Massachusetts, and New York.  Let those states wallow in their own filth, debt, and ever increasing taxes.  Instead, take charge and opt out of them.  Stop paying into those defunct systems and move away.  Concentrate in places where we can control the elections, the schools, the local law enforcement, and ultimately empower our way of life.  To use the cliché, “if we build it, people will come” is justified.  As we set ourselves apart and demonstrate a workable better life, more and more people will turn away from their current unsustainable, rat race existences and seek something better for themselves and their families.  People want this and are thirsty for leadership, but to date, few have stepped up.  If we lead, the masses will follow.

The model outlined above is feasible, suitable, and something that could be quickly accomplished in the near term.  Much debate surrounds the “optimum” prepper retreat location, but it is unnecessary because few states truly fit the bill.  Further, most of the debate is academic because true survival will not come from hiding and hoping tyranny will overlook you.  Instead, we must recognize “prepping” is not just an action but a way of life that must be protected and nurtured.  To truly survive, we must come to terms with reality and engage in an effective course of action with a chance of long term success.  We must change the debate and public perception of preppers.  We need to show the public we are absolutely no threat, peaceful, and reframe ourselves as a persecuted minority requiring protection, much like the Amish or Mennonites.  To effect this we must concentrate our numbers in specific localities.  The best prepper locations to concentrate at first will be areas of low population density, but ample natural resources.  Further, it is only reasonable to first target locations within states that predominately tend to support freedom, liberty, and independence or in short, support a prepared lifestyle and are not burdensome with respect to taxes and regulation.  This means that an ideal state probably will not have a large, leftwing, urban center like New York City, Philadelphia, or San Francisco that disproportionately biases the elections.  That immediately rules out states such as California, Massachusetts, Maryland, and New York.  You would also want to avoid locations with staggering debt or other lingering problems that would be materially detrimental to building new communities.  Out west, states such as Idaho, Montana, North and South Dakota, and Wyoming offer the best options to concentrate.  Idaho has long been recognized as an ideal redoubt and is already demonstrating that this model works.  Not only have local and state leaders been elected, but representatives at the federal level have been elected and are now insulating Idaho from many of the problems facing the rest of the nation.  In fact, businesses are also moving to Idaho.  Gun and ammunition manufacturers in particular have found Idaho a great place to set up business.

In the east, West Virginia may well be on its way to becoming the prepper redoubt of choice.  West Virginia’s topography is well suited to the defense and has a very low population density.  There are entire areas of West Virginia that have zero electronic emissions.  The federal government has also recognized West Virginia’s suitability for surviving an apocalypse and has built various “hollow mountains” throughout the state.  Unlike many other potential redoubts, West Virginia is a realistic location to bug out to from most areas along the East Coast and is not prone to natural disasters such as hurricanes, tornadoes, or large earthquakes.  It is also well protected from potential nuclear blasts and is not seen as a high value target for terrorists.  Further, West Virginia really doesn’t have any major metropolitan areas that will spill millions of refugees into the surrounding hinterlands.  The climate is very suitable for growing a variety of crops and the state is rich in natural resources that range from salt and coal to timber and natural gas.  West Virginia tends to not be heavy on regulation and the people are generally conservative minded and live already as semi-preppers.  West Virginia also has the potential to be a leader in alternate energy.  It has endless ridgelines for wind and solar power as well as many streams and rivers suitable for various scale hydroelectric systems.  West Virginia is an outdoorsman’s paradise, yet is still located close enough to eastern population centers that it will have increasing influence.  Given the low population density and the affordability of homes and property in West Virginia, it would be relatively easy for preppers in the mid-Atlantic to relocate and take up residence in a few targeted counties such as Hampshire, Hardy, Mineral, and Grant counties in the eastern panhandle.  By concentrating in these counties and gaining a strong percentage of the voting block, like minded preppers could essentially establish a food hold in the heart of the mid-Atlantic and establish their own model community.  Note that it is not necessary to even gain a voting “majority” in these counties because the influence of a well-organized and active electorate will be more than sufficient to sway, skew, and control any local election.  Further, voter turnout; especially at the local level and during primaries, tends to be extremely low so it would be possible to not only oust incumbents on tickets, but stack the local and state governments with our candidates.  From those initial gains, we could fundamentally change how local and then state governments operate in the near term and demonstrate a better way of living to the nation.  Ultimately, we will fundamentally change the thinking nationwide and to this end, achieve our goals of independence, liberty, and sustainable living.

I challenge each of you today to disseminate this message as widely as possible, to as many people as possible.  Sow the seeds of liberty and freedom again in people’s minds.  Let them know that they don’t have to accept the status quo and can change their situation now.  There are no longer empty frontiers to escape to and waiting till the SHTF will be too late.  We must pick our ground wisely now so that we can stand our ground later.  By doing something as simple as moving your state of residence (even if that doesn’t mean you physically move) so that you can (and must) vote in Idaho or West Virginia, we absolutely can improve our lives and the lives of others.  Follow my lead and begin the process of stacking the deck in these two states where as little as a hundred votes can control the officials elected at the local and state level.  Idaho and West Virginia are not the end, but the beginning.  From these two localities we can expand our communities to the surrounding regions and states, but we have to begin somewhere and we have to begin now.

Do You Know Your Fourth Amendment Rights? Part I

Daily we hear of new encroachments upon our civil liberties.  The Fourth Amendment, which protects against unreasonable search and seizure, is under particular assault.  From unconstitutional electronic surveillance of your emails and phone calls by the National Security Administration to illegal stop and frisks on the streets of New York, the 4th Amendment appears to be all but destroyed.  However, few people actually understand what their rights are and are not under the 4th Amendment.  This amendment will help provide you the essential practical knowledge and understanding of your rights and how to exercise them.

To understand how your civil liberties are being eroded, taken, and illegally violated, one must understand what the legal casework and Constitutional basis for those rights.  Further, whether you agree or not with the current legal understanding of the right, you must understand how the courts currently interpret it.  This series provides you the information on how the “courts” currently interpret the law and not how it theoretically should or should not be interpreted.  Also, the 4th Amendment only protects an individual from violations by members of the government or the “state.”  The 4th Amendment doesn’t extend to protecting an individual from being searched or seized by another private person.

The 4th Amendment states:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath of affirmation, and particularly describing the place to be searched, and the persons or things seized.

To begin, the 4th Amendment was designed to protect the people from the government and explicitly limited the powers of what the government can do.  This amendment in the Bill of Rights was added as a result of the hard lessons learned suffering under unrestrained British searches and seizures of the colonists’ homes, belongings, and persons before and during the American Revolutionary War.  The founding fathers realized correctly that if limits were not placed on the government, the very essence of privacy would be so eroded as to reduce all sense of true liberty and freedom.  For this reason, the 4th Amendment is one of the most important the Bill of Rights conveys upon Americans.

The first clause of the 4th Amendment requires that ALL searches and seizure to be “reasonable” is perhaps most often misunderstood.  The legal bar guiding all 4th Amendment action is that searches and seizures must be “reasonable” from the viewpoint of a “law enforcement officer.”  The difference between the standard for reasonableness of a person and a trained law enforcement officer is often the cause of much public misunderstanding of the right.  For example, many believe you must be under arrest to be detained, searched, and handcuffed.  This is not true.  An officer can temporarily detain, cuff, and “frisk” a suspect for weapons without an actual arrest in order to develop probable cause.  Note that probable cause is NOT a primary requirement for an initial limited search and seizure, only reasonable suspicion is required.  Specifically, to temporarily detain a person, an act known as a “Terry Stop,” only requires an officer to have reasonable suspicion crime is afoot and the person is involved.  This is different than a voluntary encounter where the person has the ability to simply leave since a suspect is NOT free to go during a Terry Stop.  Further, if the suspect tries to resist or flee, the officer is empowered to use whatever reasonable force is necessary to “seize” the suspect up to and including deadly force.  Traffic stops are prime examples of Terry Stops.  The suspect is not free to leave and the officer can use reasonable force to stop and if necessary arrest the suspect.  However, this is still limited.  If an officer is unable to further develop evidence to support “probable cause,” the officer must release the suspect.

To go further and “frisk” a person during a Terry Stop requires that the officer reasonably believes the suspect is “presently armed and dangerous.”  This is considered an 4th Amendment search by the courts so it is limited in its scope.  The search allows for a limited, but thorough pat down, specifically, for weapons.  Should the search go beyond that, the officer has most likely violated your rights.  Examples would include extensively and repeatedly searching one area, “manipulating” items with the fingers, and removing clothing (not including large bulky coats and similar outerwear).  However, weapons can be concealed and can be very small.  This gives officers cause to make a fairly detailed search of a suspect.  Furthermore, if contraband is found during the search, it is admissible in court.  For example, during a frisk, if the officer finds something that he “immediately recognizes” to be drugs, he can seize the drugs, place the suspect under arrest, and then conduct a full and detailed “search incident to arrest.”  It is also worth noting that the courts have repeatedly affirmed that a suspect has no right to lie.  If an officer asks whether you have a weapon on not, one would be best off to admit it up front or say nothing.  For example, if an officer asks you specifically if you have a gun on your person and you lie, you could potentially be arrested even if you have a permit.

Terry frisks can extend to the immediate area the suspect is in and any items he or she has control over such as a briefcase, backpack, or purse.  In the case of traffic stops, this could include the passenger cabin of a vehicle and any passengers if there is a reasonable suspicion that the suspect is presently armed and dangerous.

So how do you protect your privacy and leverage your 4th Amendment protections to the best of your ability?  First, understand that officers can arrest you as soon as they have probably cause, which can be a fairly low bar if articulated properly.  What this means for you is that you will not win the war of words with an officer on the street and certainly not win if you resist.  Understand the law is overwhelming stacked in the favor of law enforcement officers and intentionally so for better or worse.  If the arrest is improper, it will be through the courts that you will be able to air your grievances and seek remedy.

The next fundamental to understand is that if an officer asks permission to search, it is probably because they do not yet have the evidence to allow them to search.  As such, politely say no.  Most often, the request to search is done to develop both reasonable suspicion and probable cause as the officer is not limited by the 4th Amendment when conducting “consensual” searches.  If you do give permission, you can at any time ask the officer to cease, just make sure you stay close enough to your belongings that you can articulate your intention if necessary.   If the officer goes ahead and searches anyhow, he either already had enough cause or it was an illegal search.  Either way, it will be ultimately for the courts to decide.

Outside of an arrest where you will be searched thoroughly, only items and areas readily accessible to the suspect can be searched during a Terry Stop.  Respective of vehicles, this means that a locked glove box, locked container, and the trunk are off limits unless the officer finds enough evidence to warrant an arrest.  If an arrest is made the vehicle will be impounded and inventoried, which in practice turns into a full detailed search of the entire vehicle.  For SUVs, the area in the back of the vehicle is also off limits to being searched.  However, the area must be covered up as any contraband in “plain view” is fair game.  One would be wise to keep their insurance and registration information separate from any items that might be stored in a “locked” glove box since to retrieve them one must “unlock” the glove box making it open to a search.  Respective of your person, one should password protect and encrypt any electronic media to include cell phones and laptops.  If you carry a briefcase, make sure it can be locked.  For ladies, placing a locked box in your purse for valuables is a viable option as well.  What this does is removes the officer’s ability to articulate that he needed to search that area for weapons to ensure “officer safety.”  If it is locked and then placed out of reach, it is not a threat and is not searchable beyond a cursory external inspection short of actual probable cause for arrest or you give consent.

Now that you understand the basic practical application of the first clause of the 4th Amendment, you are better able to stand up for your rights and recognize when a violation has occurred.  Further, you should now be able to intuitively see why New York City’s “Stop and Frisk” policy violated your rights since it was “unreasonable” to stop a random person on the street that was neither suspected of being involved in a crime nor presently armed AND dangerous.  Taking this further, one should heavily question the constitutionality of TSA searches of passengers for airline flights, which are now being expanded to all public transit.  This doesn’t mean that all searches would be unconstitutional, just unreasonable ones where no reasonable suspicion someone is presently armed and dangerous exists.  If challenged in court, the searches will not be likely to withstand strict constitutional scrutiny and should be struck down.  However, in the meantime, the TSA justifies the searches through a complex and perverse web of legal interpretations and stalling by our elected leaders to put an end to the vile practice.  TSA defenses for the searches have ranged from a person doesn’t have a right to travel and so voluntarily flies and must consent to a search to an extremely dangerous interpretation that suggests anyone at any time could “reasonably” be a terrorist with the intent to attack so everyone must be searched.  The latter interpretation is patently chilling to the basic tenets the 4th Amendment was established to protect and would utterly destroy the notion of “reasonableness” that has been the legal bar when courts have decided on whether or not a search and seizure violated one’s rights.

In Part II on the 4th Amendment, the second clause will be examined and discuss how to protect your privacy at home.  If you don’t understand “curtilage,” you definitely need to read the upcoming article.
